Terms of use

These terms are the agreement between you and Hard Yes Limited ("we", "us"), a New Zealand company, for using the Hard Yes app and website. We've kept them as short and plain as we can. By using Hard Yes, you agree to them.

Who can use Hard Yes

• You must be 18 or over.
• Hard Yes is for couples. Guests can only join when both partners invite and approve them.
• One account per person. Keep your sign-in to yourself and let us know if you think someone else has accessed your account.

Consent comes first

Everything in Hard Yes is built on both of you saying yes. A match is an invitation, never an obligation. Either of you can change your mind at any time, including in the moment. Please respect each other's limits, and anyone else's.

What you can't do

• Share anything involving anyone under 18.
• Share intimate images of anyone without their consent, or share anything you received from someone else outside Hard Yes.
• Harass, threaten or pressure anyone, or use Hard Yes to arrange anything illegal, including paid sex.
• Pretend to be someone else, or try to get into anyone else's account or data.
• Copy, reverse-engineer or misuse the app, or interfere with how it works.

If you break these rules, we may remove content, suspend or close your account, and where the law requires it, report it to the authorities.

Your content

What you write, answer and send is yours. You give us permission to store and process it only so we can run Hard Yes for you, as explained in our privacy policy. Your couple chat and photos are end-to-end encrypted, so we can't read them.

Premium

Hard Yes is free to start. Premium is a subscription sold through the App Store or Google Play, and their terms apply to payment, renewal, cancellation and refunds. Subscriptions renew automatically until you cancel in your Apple or Google account settings. One subscription covers both partners in a couple.

Health and wellbeing

Hard Yes isn't therapy, medical advice or a substitute for professional help. Any tips about sexual health, relationships or wellbeing are general information. If you need support, talk to a doctor, a sexual health service or a counsellor. Anything you choose to do, including with guests or during solo play, is your decision and your responsibility. Please look after yourselves and each other.

Our service

We work hard to keep Hard Yes running smoothly and safely, but we can't promise it will always be available or free of errors. We may change or improve features over time. If we make a change that significantly affects you, we'll tell you in the app.

Liability

To the extent the law allows, we aren't liable for indirect or consequential loss, or for anything that happens between users. If you use Hard Yes for business purposes, the Consumer Guarantees Act 1993 does not apply. Nothing in these terms limits any rights you have as a consumer under New Zealand law that can't be excluded.

Ending

You can stop using Hard Yes and delete your account at any time from Settings. We may suspend or close accounts that break these terms.

General

These terms are governed by New Zealand law, and New Zealand courts have jurisdiction. If we change these terms in an important way, we'll tell you in the app before the change applies.
